Power of
Attorney

When you make a Power of Attorney, you are known as the Donor. The person or people you choose to act on your behalf are called Attorneys. You can appoint more than one Attorney and decide whether they must make decisions together or if they are allowed to act independently.

You can give your Attorney broad authority to manage your affairs or limit their powers to certain tasks or assets. It’s entirely your choice.

Your Attorney must:

• Always act in your best interests
• Consider your known wishes and usual way of doing things
• Stay within the limits of the authority you’ve given them

You can decide whether your Attorney’s authority starts immediately or is held in place for the future, to be used only if it’s ever needed.

While most Powers of Attorney continue to apply if you lose mental capacity, you are free to cancel or change them at any time as long as you still have the capacity to make that decision. Likewise, your Attorney has the right to step down from the role if they no longer feel able to act on your behalf.
